Types of Divorce

Divorce can be categorized into three major forms:

Talaq

This category of divorce is initiated by the husband. The husband has the right to dissolve the marriage by talaq. Taliq may be oral, in written, or through electronic devices. The concept of 3 talaqs, each one after one month,  is applied here in order to dissolve the marriage. 

Khula

Khula is the right of a wife to dissolve the marriage. Khula is initiated from the wife’s end. Usually, khula is followed by the claim of dowry articles and child maintenance allowance, if any, from the wife and is carried out by a lawyer in the court. 

Divorce Through Mutual Consent

Dissolution of marriage may start from any of the spouse sides by their mutual consent. However, it should be documented and should be written on e-stamp paper. The spouses may decide terms and conditions mutually while dissolving the marriage.

The procedure of Divorce or Khula

Case of divorce or khula may be filed by a woman in any family court across the country. A woman has the right to file a case in any city. For filing the divorce or khula case, the services of an expert family lawyer are necessary, so that all the process may be made legal by preserving the rights of a woman.
