Validity of Shara’i Nikah in Pakistan

Shara’i Nikah is completely valid in Islam but it has less legal recognition in Pakistan. In law court marriage is more valid as compared to Shara’i Nikah because court marriage is conducted according to rules and regulations of law.

Shara’i Nikah is valid in all cities of Pakistan, including Islamabad, Rawalpindi, Lahore, Multan, Faisalabad, and even all over the world but it lacks validity in courts of Pakistan.

The Procedure of Shara’i Nikah

Shara’i Nikah is simply performed by the exchange of vows ( Ijab o Qabool) between bride and groom in the presence of male witnesses and with the decided dowry (Mahr).

Shara’i Nikah does not require any legal formality or registration, therefore, it lacks validity in courts.

Civil Marriage is performed by fulfilling the legal requirements and it is documented and registered by court. So, it is also more valid in Pakistani courts. Civil marriage provides more protection for the rights of spouses.
