Court marriage in Islam is permissible because court marriage is performed by following the teachings of Islam and in a court marriage ceremony the nikah is conducted according to the Islamic law.

In court marriage, nikah is also performed by asking for the consent of both bride and groom in the presence of witnesses, and then the Nikah Nama is signed by both bride and groom and the witnesses. The difference is that the ceremony is performed in the presence of a lawyer. This marriage is performed in the office of an advocate in the premises of the court, so in Pakistan, we can call this a wakeel marriage instead of a court marriage.

Recording Statement in front of Magistrate

When nikah is performed in the presence of a lawyer and the families of the bride and groom, the process is complete. But if the court marriage is performed in the absence of Wali the statement should be recorded in front of the magistrate about the free will of getting married for the security of the couple we can call this statement‘’ a marriage without Wali’’. To record this statement is not necessary but if you want more security about your union you can do this. Otherwise, this is optional. On the other hand Affidavit of Free Will by the bride is essential.

Validity of Court Marriage in Islam

Court marriage in Islam is valid. According to the Islamic perspective, the essentials of Nikah (Islamic marriage) are the ejab o qabool, and the free consent of both bride and groom.in Islam  Nikah. This contract may be verbal or written. The marriage performed by following these conditions is valid in Islam. So court marriage is also valid both Islamically and legally.

Wali

A Wali in ISlam should be a Muttaqi person who follows the commands of Allah and lives life according to the teachings of Islam. A Wali has qualities of ongoing good acts, iman, and worship. Any person having all these qualities can be the Wali of the bride.
